How to Get Power of Attorney Online: A Complete Guide

Need to authorise someone to handle a property transaction, represent your company, deal with paperwork or complete another specific task? A Power of Attorney (PoA) can allow a trusted person to act on your behalf.

In many cases, arranging a PoA no longer has to mean travelling to an office and coordinating documents for days. Depending on the country, document and receiving organisation, you may be able to meet with a notary by video call and have your document notarised quickly — sometimes on the same day.

The key is to confirm the requirements before signing. A Power of Attorney that works for one purpose or country may not meet another authority’s rules.

What is a Power of Attorney?

A Power of Attorney is a written document in which one person, known as the principal, authorises another person, known as the agent or attorney-in-fact, to act on their behalf.

The authority can be limited to one task or cover a wider set of matters. A PoA may, for example, allow someone to sign documents for a property transaction, represent a business before an authority or registry, collect documents, submit an application, or carry out a transaction while the principal is abroad.

A Power of Attorney does not automatically give the agent unlimited authority. Its scope depends on the wording and the applicable law. Be clear about who will act, what they may do, where they may act and how long the authorisation will remain valid. For example, Estonia’s General Part of the Civil Code Act addresses authorisation and the scope of a representative’s authority; rules differ by jurisdiction.

When might you need a Power of Attorney? Common use cases

A Power of Attorney can be useful whenever you cannot, or do not want to, personally complete a defined task. The right document depends on the country, the organisation receiving it and the authority you want to delegate. Keep the powers specific: name the task, the people or organisations involved, any limits and, where appropriate, an expiry date.

Registering or setting up a company

If you are abroad, a representative may be able to help with defined company-formation steps, such as preparing or submitting documents, communicating with service providers, or handling a filing that the relevant authority permits an agent to complete. A Power of Attorney does not replace any identity checks, founder approvals, personal digital signatures or other formalities required by the commercial register. Confirm the exact signing and filing route before you appoint someone. For Estonia, consult the official e-Business Register portal for its online registration process and digital-signature requirements. For an overview of registration of a company in Estonia, check the current process and requirements.

Buying or managing a ready-made company

When purchasing a ready-made company, a representative may be authorised to handle agreed transaction paperwork, communicate with the seller or service provider, or complete specific administrative steps. The document should say exactly which actions are permitted; do not give authority to sign a share transfer, make payments or change company details unless you intend to grant those powers. Learn more about ready-made companies and check the transaction documents before signing.

Property, banking and administrative matters

People also use a PoA for a particular property transaction, to collect records, submit an application, represent a company before an authority, or deal with selected banking or tax matters where the recipient accepts an authorised representative. Banks and public authorities often apply their own forms and identity checks, so ask them in advance whether they accept a PoA, what wording they require and whether notarisation, an apostille or a translation is needed. For tax matters, the Estonian Tax and Customs Board (EMTA) explains how to authorise a representative to use e-MTA. See EMTA’s guidance on granting access to its e-services.

Acting across borders

A PoA signed in one country for use in another may need notarisation, an apostille or legalisation, and sometimes a certified translation. Start with the organisation that will receive the document: its requirements determine what must be prepared and certified. If the task is important or involves money, property or control of a company, consider independent legal advice and grant only the authority needed for that task.

Who handles a Power of Attorney?

The principal grants the authority, while a lawyer or other qualified legal professional may help prepare or review the wording. A Notary Public may witness the signature, verify identity or certify the document, depending on the applicable rules.

The notary’s role varies between countries. In Sweden, Notaries Public are appointed by the County Administrative Boards and can perform certain document certifications and issue apostilles. See the Swedish County Administrative Boards’ information about Notaries Public.

Notarisation does not necessarily mean that the notary has checked whether every clause is suitable for your legal situation. If the PoA concerns significant property, financial or business decisions, consider getting legal advice on the wording.

What does a Power of Attorney look like?

There is no single international template. A PoA generally identifies the principal and authorised person, describes the permitted actions and sets out any limits or expiry date. Depending on its purpose, it may also need a signature, witnesses, notarisation, an apostille or legalisation, and a certified translation.

The receiving organisation may have its own form or require specific wording. A bank, court, company registry or property authority may reject a document that is too general, missing details or prepared in the wrong language. Before signing, ask the organisation that will receive the PoA what it requires.

Do you have to visit a notary’s office?

Traditionally, a person signing before a notary would arrange an in-person appointment. That is still necessary in some situations. But some notarial services also offer appointments by video call. For example, notarial services in Stockholm advertise both office and video appointments. Check the service’s published appointment information.

Online does not always mean that every step is digital. You may still need to print and sign the PoA during the appointment, send an original by post or arrange physical delivery. Some receiving authorities require an in-person notarisation or a particular signing method. In Estonia, the Chamber of Notaries explains how remote authentication works and notes that the notary decides whether a specific transaction can be handled remotely. Read the Chamber of Notaries’ guidance on remote authentication.

How to get a Power of Attorney online

  1. Confirm the recipient’s requirements. Ask whether it needs a specific form, wording, language, notarisation, witnesses, apostille or legalisation.
  2. Prepare the document. Use the recipient’s form if available, and make sure the PoA clearly states what the agent may do.
  3. Arrange a notary appointment. Confirm the notary can handle your document and whether a video meeting is accepted by the recipient.
  4. Show identification and sign as instructed. Have valid ID and the final document ready. Follow instructions about when and how to sign.
  5. Arrange certification and delivery. Confirm whether you will receive a notarised document, apostille, translation or other certificate, and whether the original must be delivered.

Can you get a same-day notary appointment?

Sometimes. Some providers advertise same-day appointments or document services, subject to availability and the type of document. A notarial service in Stockholm, for example, lists video appointments and advertises same-day apostille and legalisation services. Check availability directly with the provider.

Same-day availability does not guarantee that the entire PoA process will be completed that day. Timing may depend on whether your document is ready, identity can be verified, the required notarial act can be performed remotely, or an apostille, translation or physical delivery is needed.

What is an apostille, and when might you need one?

An apostille is a certificate used to authenticate the origin of a public document for use in another country covered by the Apostille Convention. It confirms matters such as the authenticity of a signature and the capacity in which the signer acted. It does not certify that the document’s contents are legally correct or guarantee acceptance by the recipient. Read the HCCH explanation of apostilles.

Whether your Power of Attorney needs an apostille depends on the country where it was signed, the country where it will be used and the recipient’s requirements. Some documents may instead need legalisation, a certified translation or no additional certification. Certain public documents moving between EU Member States may also be exempt from apostille requirements under EU rules. See the Government of Sweden’s overview of EU exemptions.

Ask the receiving organisation which form of certification it requires before booking. When an apostille is needed, check which authority can issue it in the country where the document was notarised.

Common mistakes to avoid

  • Using a generic template without checking the recipient’s rules.
  • Assuming an apostille approves the PoA’s contents.
  • Booking a remote appointment before confirming the recipient accepts it.
  • Overlooking translation, original-document or delivery requirements.
  • Giving broader authority than necessary.

Frequently Asked Questions About Getting a Power of Attorney Online

What is a Power of Attorney?

A document that authorises another person to act on your behalf for a specific task or a broader set of responsibilities, subject to its wording and applicable law.

How can I get a Power of Attorney online?

Check the recipient’s requirements, prepare the document, arrange a remote notary appointment if accepted, verify your identity and sign as instructed. An original document may still need to be posted.

Can I get a Power of Attorney notarised by video call?

Some notarial services offer video appointments. Whether your PoA can be handled remotely depends on the notary’s procedure, the country and the recipient’s rules.

Do I need to visit a notary in person?

Not always. A remote appointment may be possible, but some documents and recipients require an in-person signing. Confirm before booking.

Can I sign a Power of Attorney completely online?

Not in every case. You may meet the notary online but still need to print and sign the document, provide an original or arrange physical delivery.

What information should a Power of Attorney include?

It generally identifies the principal and agent, describes the permitted actions and states any limits or expiry date. Exact requirements vary.

Can I use a general Power of Attorney for one specific transaction?

Possibly, but a recipient may require wording that names the transaction or describes the agent’s authority in specific terms. Ask for its preferred form.

Who can prepare a Power of Attorney?

You may use a form from the recipient. Depending on the matter, a lawyer or qualified professional may prepare or review it. Some notarial services also offer drafting.

Does a notary write my Power of Attorney?

Not necessarily. Drafting may be separate from witnessing a signature, verifying identity or certifying a document. Ask what the appointment includes.

What documents do I need for an online notary appointment?

You will usually need valid identification and the final document. The notary may request additional information depending on the service.

Can I get a Power of Attorney notarised on the same day?

A same-day appointment may be available if the provider has an opening and your document is ready. Apostille, translation or delivery may take longer.

How long does it take to get a Power of Attorney online?

The appointment may be short, but the full process can take longer if the document needs changes, certification, translation or physical delivery.

What is an apostille for a Power of Attorney?

An apostille authenticates the origin of a public document for use abroad in countries covered by the Convention. It does not validate the document’s contents.

Does every Power of Attorney used abroad need an apostille?

No. Requirements depend on the countries, document and receiving authority. Some documents need legalisation or translation instead, while others need no additional certification.

What is the difference between an apostille and legalisation?

They are different processes for authenticating documents for use abroad. Which one applies depends on the countries involved and the recipient’s requirements.

Does an apostille make my Power of Attorney legally valid?

No. It authenticates the origin of a public document or notarial certificate; it does not confirm that the wording is suitable or that the recipient must accept it.

Do I need to translate my Power of Attorney?

The recipient may require the PoA in a particular language or with a certified translation. Check before signing.

Will a scanned copy of a notarised Power of Attorney be accepted?

Some organisations accept scans; others require the original paper document or a specific electronic format. Ask the recipient first.

Can I get a Power of Attorney while I am abroad?

A remote appointment may be possible, depending on the notary’s procedures and recipient’s rules. Your location may affect identity checks, signing or delivery.

Can someone else sign the Power of Attorney for me?

That depends on the applicable law and circumstances. Do not assume another person can sign for you; ask a qualified professional or the recipient.

Can I limit what my representative is allowed to do?

Often, the document can specify powers, conditions or an expiry date. The wording should match the intended task and the recipient’s requirements.

Can I cancel or revoke a Power of Attorney?

The process depends on applicable law and the document’s terms. You may need to notify the agent and any organisation that received the PoA.

Can a Power of Attorney be used in another country?

It may be used abroad, but the recipient may require specific wording, notarisation, apostille, legalisation or translation. Confirm its requirements first.

Is a Swedish Power of Attorney automatically accepted in another country?

No. Acceptance depends on the destination country and recipient. A Swedish notary may issue an apostille, but the recipient’s requirements still apply.

Do all documents need an apostille between EU countries?

No. Certain public documents and certified copies may be exempt when issued in one EU Member State and presented to authorities in another. The exemption covers specified categories, so check whether it applies to your document.

What should I check before booking an online notary appointment?

Confirm the recipient accepts the method, ask about its form and wording, and check whether you need an apostille, legalisation, translation or original document. Then ask about ID, availability, fees and delivery.

Where can I get help with a same-day notary appointment?

Request a consultation to discuss your document, possible appointment options and certification requirements. Availability and timing depend on the notary, document and recipient.
